Modacta, Inc., a California corporation (collectively, “Modacta”, “we”, “our”, or “us”), owns and operates the Morning Prompt website located at www.morningprompt.com (the “Site”).
This Privacy Notice (“Privacy Notice”) is intended to help you better understand how we process your personal information, and governs how Modacta may use, transfer, store and disclose personal information that we collect when:
- You visit the Site;
- Any services provided by us to you in connection with your use of the Site;
- Your directly communicate with us; and
When we refer to the “Services” throughout this Privacy Notice, we mean, collectively, the Site and any related services provided by us to you in connection with your use of the Site.
2. Updates to this Privacy Notice
Modacta may need to update this Privacy Notice from time to time. If so, we will post an updated Privacy Notice on the Site along with a change notice on the Site, as well as a notification through the user interface of the that this Privacy Notice has been updated. If we make material changes, we may also send registered users a notice that this Privacy Notice has been changed to the email account we have on file for such users. Where express consent is required by applicable law for the lawful collection, use, or disclosure of information about you, we will obtain that consent. We encourage you to review this Privacy Notice regularly for any changes. Your continued use of the Services and/or your continued provision of personal data to us after the posting of such notice will be subject to the terms of the then-current Privacy Notice.
3. Information We Collect From You
When you visit the Site and/or use the Services, and depending on the purpose of your visit, Modacta may collect the following information:
Registration Information: When you sign-up and/or register to receive the Morning Prompt Newsletter and/or other marketing communications, we collect the following information:
- Your email address(es).
Other Information: Modacta will collect any other information you may provide by filling out forms or by contacting us (such as your feedback or other communications with us).
Cookies (and Related Technologies)
A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. When you visit or access the Services, we may by means of cookies, beacons, tags, scripts, and/or similar technologies automatically collect technical information about the devices and software you use to access the Services, such as the type of Internet browser or mobile device you use, the website or source that linked or referred you to the Services, your IP address or device ID (or other persistent identifier that uniquely identifies your computer or mobile device on the Internet), the operating system of your computer or mobile device, and other similar technical information.
We use both session ID cookies and persistent cookies. Modacta tracks users use of the Services, but does not track users across third party websites. These same technologies (or a combination of them) may also be used to help us:
- Compile statistics and analytics about your use of and interaction with the Services, including details about how and where our Services are accessed, how often you visit or use the Services, the date and time of your visits, and your actions on the Services;
- Gather important functionality, testing, and performance data about our Services, including performance data related to the Services, such as networking activity, CPU load, and resource usage, among other relevant data;
- Moderate user behavior on the Services, such as protecting against fraud and other inappropriate activities;
- Gather demographic information about our user base; and
- Perform other similar functions.
We may use third party tools and technologies to help us gather this information discussed above. For instance, we use Fabric and Firebase, products provided by Google, Inc., which includes, Google Analytics to collect and process certain analytics data with technologies such as tracking pixels.
Google provides some additional privacy options described at www.google.com/policies/privacy/partners/ with respect to Google Analytics cookies. To opt out from Google Analytics, you can download a plug-in from http://tools.google.com/dlpage/gaoptout.
Typically, all technical, analytics, and usage information is gathered by Modacta in anonymous form and does not identify you personally.
4. Sensitive Data
Modacta does not require you to provide any sensitive data about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic, and biometric data to use the Services.
5. Children’s Privacy
Use of the Services is not intended for individuals under the age of 16. Without limiting the foregoing, Modacta does not target the Services to persons under the age of 16 and does not knowingly collect personal data from minors. Therefore, we ask you not to provide us with personal information of persons under the age of 16. If we learn that personal information of persons under 16 years of age has been collected on or through the Services, then we may deactivate the account or otherwise terminate access to the Services and/or make the user content inaccessible.

We use your personal data to improve the content and general administration of the Services, provide you with customer support, improve the Services and to detect fraud, illegal activities or security breaches.
7. Information We Share
Modacta does not sell, rent, or trade your personal information with third parties other than as disclosed within this Privacy Notice. Modacta may share your information as set forth below or with your prior consent if required by applicable law.
Service Providers, Agents and Contractors
Modacta may share users’ information with our third party agents, contractors, or service providers who are hired to perform services on Modacta’s behalf (collectively, “Providers”). These Providers may operate or support certain functions of the Services that we offer. Below is an illustrative list of functions for which we may use Providers and the names of the Providers we may use to perform these functions:
- Analytics services (e.g., Google, Inc.)
- Customer support services.
We may disclose personal information about you as required or permitted by law and/or to comply with a judicial proceeding, court order, or legal process served on our Services. To the extent permitted by applicable law, we also may disclose personal data about you in response to a request from law enforcement agencies, regulators or other public agencies (including schools or children services) or if we believe such disclosure may prevent a crime, facilitate an investigation related to public safety or protect the safety of a child using our Services, protect the security or integrity of our Services, or enable us to take precautions against liability or to protect our rights.
We may disclose or otherwise transfer information about our users, including personal data, to an acquirer, successor, or assignee as part of any merger, acquisition, sale of assets, or similar transaction, or in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.
We share aggregated, automatically-collected or otherwise non-personal information with third parties for various purposes, including (i) compliance with reporting obligations; (ii) for business or marketing purposes; (iii) to assist us and other parties in understanding our users’ interests, habits and usage patterns for certain programs, content, services, advertisements, promotions and/or functionality available through the Services. We do not share personal information about you in this case.
8. Marketing Communications
If you have not otherwise opted out, or if you have opted in to receive direct marketing emails from us, we may use your personal information to send you marketing information about the Services. For instance, when you request additional information regarding the Services or sign up for our newsletter, we may ask if you wish to opt in to receive marketing communications from us for the Services. This is what we call direct marketing. We carry out direct marketing by email. We obtain consent to send you such communications where required under applicable local laws.

Modifying Information: If you have provided us any personal data, you may request to review, and/or make changes to such personal data in our possession and/or control by contacting us as at email@example.com.
Marketing & Communications: You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any of our marketing e-mails. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our databases. You cannot opt out of receiving transactional e-mails related to the Services (e.g., requests for support).
Cookies and Related Technologies: In order to manage your cookie preferences, you may alter the cookie settings in your browser settings at any time. You may accept all, or certain, cookies. Please note, however, that by blocking or deleting cookies used on the Services, you may not be able to take full advantage of the Services and you may not be able to properly log on to the Services.

- You may turn on the Do Not Track (“DNT”) setting in your browser, which will enable your browser to send a special signal to websites, analytics companies, plug in providers, and other web services you encounter while browsing to stop tracking your activity. - With respect to social media “share” buttons and/or plug-ins, many of these social media sites handle tracking differently depending on whether or not a user is logged in and the preferences selected by users. If you use social media and want to protect your browsing privacy, we recommend that you adjust your individual settings for each third-party social media company with whom you have an account, so as to minimize cross-site tracking.
- Note that Modacta does not process or respond to web browsers’ “do not track” signals or other similar transmissions that indicate a request to disable online tracking of users who use our Services.
We retain personal data for as long as needed or permitted in light of the purposes for which it was obtained and consistent with applicable law. We use the following criteria to determine our retention periods: the length of time we have an ongoing relationship with you and provide you with access to our Services; if there is a legal obligation to which we are subject; and whether retention is advisable in light of our legal position (such as statutes of limitation).

On or through the Site, we may provide third-party “share” buttons for YouTube, Facebook, Twitter, Instagram and/or other social media sites, which may function as web beacons when you interact with the button. Please note that you may send to the third party the information that you are viewing on a certain part of the Site when you “share”. If you are not logged into your account with the third party, then the third party may not know your identity. If you are logged in to your account with the third party, then the third party may be able to link information or actions about your interactions with the Site to your account with them. The Services and its servers are operated in the United States. If you are located outside of the United States, please be aware that your information, including your personal data, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction.
